<p>My latest<span class="Apple-converted-space"> </span><a href="http://pajamasmedia.com/blog/why-im-attending-a-tea-party/">Pajamas Media</a><span class="Apple-converted-space"> </span>piece is up and I have to say of all the pieces I&#8217;ve written, it is probably among those that I&#8217;m the most proud of:</p>
<blockquote><p>I’ve taken time off from work on April 15 to be at my local tea party. As the tea parties occur, the media will offer their spin on why people are there.</p>
<p>Large events like this are remarkable. In some ways, they’re comparable to baseball games, where you’ll find some people with an agenda aside from the game. If the media applied the same coverage to baseball games that it applies to tea parties, it would assume that, if someone gets through security and streaks across the field nude, most of the crowd are closet nudists.</p>
<p>Of course, most just want to see the game and have no interest in the streaker. Similarly, the streaker has no interest in the baseball game. He simply wants to streak nude in front of a large audience.</p>
<p>Like our baseball streaker, some at the tea parties will have their own agendas that have little or nothing to do with the cause for which most people are going to attend. Most would rather not be defined by the proverbial streaker, and I’m no exception. I’m not going to the tea party to make the case that President Obama is a Muslim born in Indonesia, to advocate secession from the union, or to explain how America’s problems are the direct results of actions by members of the Council on Foreign Relations. I’m not going as a Republican; I’m going as an American.</p>
<p>My party has let the country down with its massive overspending, corrupt career politicians, and willingness to play business as usual when it’s not called for. As much as I’m not a fan of the Obama administration, if he’s replaced in 2012 by a feckless Republican president with a feckless Republican Congress that believes only its own re-election, our country will be no better for it.</p></blockquote>

			<content:encoded><![CDATA[<p>Jim Cramer is no conservative, he&#8217;s no right winger. The CNBC Business host began his life as a reporter and he got started investing in stocks for Marty Peretz of the liberal New Republic. He doesn&#8217;t agree with Rick Santelli on the mortgage bailout. He&#8217;s fine with that. From 1997-2000, he made $120,000 in Soft Money contributions to the Democratic Party. He criticized the Bush administration for being too Laissez Faire in its handling of the stock market.</p>
<p>I don&#8217;t live or die with Jim Cramer&#8217;s stock picks, but I&#8217;ll occasionally watch his show because he&#8217;s  entertaining. Whether he&#8217;s right or wrong, who cares?</p>
<p>However, watching the Friday edition of Mad Money, Cramer has taken a remarkable turn. He &#8220;mistakenly&#8221; referred to President Obama as Jimmy Carter. He declared that President Obama has decided to attack Capitalists and that people needed to Obama-proof their stock portfolio.</p>
<p>He&#8217;s begun a 6-part series on making your portfolio Obama resistant. His first strategy: He&#8217;s calling for his viewers to buy Foreign Stocks. &#8220;You need to own a stock outside this country. Something&#8217;s that beyond Obama&#8217;s reach.&#8221; He points out that Australia is less likely to go the way of the U.S. because they don&#8217;t want to return to the days of indentured servitude.</p>
<p>Comparing the U.S. Stimulus to the Chinese Stimulus, Jim Cramer declared, &#8220;The Chinese government is stimulating it&#8217;s economy, our government is stimulating Nancy Pelosi&#8217;s agenda.&#8221;</p>
<p>Now, let&#8217;s repeat. Cramer is no conservative, Cramer is a big time Democrat who contributed $120,000 to the Democrats and he&#8217;s bearish on this administration. If he&#8217;s bearish and he thinks the administration&#8217;s going to bring disaster, what are other traders thinking? If you&#8217;ve got big money, why are you going to risk it in the United States?</p>
<p>Why not stuff it somewhere in the Cayman Islands or invest your money in China or other nations that are welcoming to Capital? Except for concern for the nation and its future. All the Wall Street folks who backed Obama assumed the Democratic Party had essentially become far more business friendly, that it had Clintonized. Clinton had no problem with people earning money, with the Dow surging, and there was huge money to be made during the dot com boom.</p>
<p>This however is Obama and there&#8217;s no reason to invest in Barack Obama&#8217;s America. He&#8217;s raising Corporate Taxes which will cut into funds being available for dividends, he&#8217;s increasing capital gains taxes in 2011 which means that if you take advantage of the low stock prices we have right now and sell at a profit, you&#8217;re going to get soaked in 2011.</p>
<p>It&#8217;s as if, just in the case the economy starts to turn around in 2010, the President wants to give traders on Wall Street an excuse to have a gigantic sell-off to avoid his absurd tax rates.</p>
<p>Why is the President doing this? Others have said it. <a href="http://www.usnews.com/blogs/capital-commerce">It&#8217;s a war on the investor class</a>. The Investor class is a growing number of Americans in recent years who have invested in the stock market through 401(k) plans, IRAs, not just big institutional investors. As the Investor Class becomes a growing concern for the Democrats.</p>
<p>Why? Because if you invest smartly and squirrel away enough money for a good retirement, you&#8217;re not going to spend your sunset years dependent on the government. There&#8217;s a danger that the Investor Class could begin to think like Investors when they vote which is going to be bad for any Democrat to the left of Clinton.</p>
<p>You&#8217;re going to shrink the investor class and grow the number of union voters. That&#8217;s the Democrats plan for success. Folks who are many years away from retirement are going to get scared into the market, scared into selling good investments that will rebound, and will end up more or less dependent on the state for their retirement. It&#8217;s great politics.</p>
<p>It&#8217;s lousy policy. Obama&#8217;s tax policies are making it far more attractive for people to invest overseas, which means less investment money in U.S. business which means less job creation, which means stagflation.<br />
No wonder Mr. Cramer is scared.</p>

			<content:encoded><![CDATA[<p>Bryan Fischer <a href="http://www.idahovaluesalliance.com/news.asp?id=1007">points out various problems with Walt Minnick&#8217;s recovery plan</a> including this point, &#8220;Deficit spending is bad whether we are talking about $174 billion or $900  billion.&#8221;</p>
<p>Apparently, Fischer has missed the fact that we&#8217;re no longer in this place called, &#8220;The Real World&#8221; but rather in Bizarro Land, where Fiscal Conservatism has become only proposing an obscene amount of spending rather than an insane amount.</p>
<p>Fischer makes several points that the various Stimulus proposals won&#8217;t work. Environmental red tape will slow down infrastructure funding, the tax cuts amount to little more than welfare and that it oversteps guidelines.</p>
<p>All of these questions are answered with a simple, eloquent and logical response:</p>
<blockquote><p>WE&#8217;RE IN A CRISIS AND WE MUST DO SOMETHING NOW! WE DON&#8217;T HAVE TIME TO THINK, WE DON&#8217;T HAVE TIME FOR ANYTHING BUT TO PASS THIS BILL OR WE&#8217;RE ALL GOING TO DIE!!!!!!!!!!!!!!!!!!!!!!!!!!!!</p>
<p>By the way, hope and change.</p></blockquote>
<p>The formula is simple:</p>
<p>1) Give tiny sums of money to people who don&#8217;t know how to create wealth.</p>
<p>+</p>
<p>2) Spending Large sums of money on a wide variety of projects that have seemingly little to do with stimulating the economy:</p>
<p>+</p>
<p>3) Run up obscence deficits and be thankful the media won&#8217;t call you hypocrites for all your hand-wringing about the Deficit during the Bush years.</p>

<p>4) Economic Recovery that goes perfectly.</p>

<p>Ethics in government apparently only matters to leftist bloggers when Republicans are in power. I&#8217;m proud of the fact that if you&#8217;ve followed this blog long, you&#8217;ve seen me willing to go after Republicans when they&#8217;re wrong, on ethics or on the issues. I don&#8217;t think you can say that for most of the Idaho blogosphere.</p>
<p>Actually, reading Hastings piece isn&#8217;t at all what you&#8217;d expect. Hastings is not prompted to call for a tax increase from 35% to 50% because of a love of paying taxes, but because of President Obama&#8217;s ham-handed attempt to regulate CEO pay. Writes Hastings:</p>
<blockquote><p>This week, President Obama proposed imposing a $500,000 compensation cap on  companies seeking a bailout. It’s a terrible idea. We all want the taxpayers’  money returned, and capping compensation at bailout recipients will just make it  that much harder for those boards to hire and hold on to the executives who can  lead their companies to compete and thrive.</p></blockquote>
<p>Hastings proposes the tax increase not out of any sense of economic understanding, but rather so that the American people&#8217;s sense of envy can be met:</p>
<blockquote><p>Of course, it’s galling when a chief executive fails and is still handsomely  rewarded. But with the concept of “tax, not shame,” a shocking $20 million  severance package would generate $10 million for the government. That’s a far  better solution than what we have today, not least because it works with the  market rather than against it.</p>
<p>Another advantage is that it would also cover the sometimes huge earnings of  hedge fund managers, star athletes, stunning movie stars, venture capitalists  and the chief executives of private companies. Surely there is no reason to  focus only on executives at publicly traded companies.</p></blockquote>
<p>Indeed, we can therefore by increasing the tax rate to 50%, get to smile with satisfaction that the rich are being soaked. But will our economy do well by taking money from people who earn money and therefore no how create businesses, jobs, and products, and is transferred to the government which these days best seems to know how to create fraud, mismanagement, and corruption.</p>
<p>Your average Congressman is guilty of more malfeasance than Bernie Madoff, and transferring more money to them is idiotic.</p>
<p>I think that by telling people 35% of these big packages are going to the federal will be just as re-assuring as increasing that number to 50% and wrecking havoc on the economy in the process.</p>
<p>Of course, Mr. Hastings may have some selfish motives in suggesting a 50% tax rate. Congressman Barney Frank (D-Ma.) is rubbing his hands together, <a href="http://www.financialweek.com/apps/pbcs.dll/article?AID=/20090203/REG/902039977/1003/TOC&amp;template=printart">dreaming of extending executive compensation limits to all businesses whether they are successful or not</a>. 			<content:encoded><![CDATA[<p>I&#8217;m just about finished with my taxes. As is usual because of my various sidelines, odd jobs, and various and sundry sources of income, I&#8217;m waiting for one final 1099 before I can close the book on this tax year.</p>
<p>When I first got into doing taxes, particularly with W2s from a paying, it was a bit of a rite of passage to do my taxes. You know, being an adult. Now, I&#8217;ve got eight years into the whole practice of taxes, it is not fun at all. It&#8217;s a big waste of time that as I&#8217;m doing it makes me wonder, &#8220;Is it really worth it to even try to earn a little extra income.&#8221; for all the hassle it takes to report it. Well, I dream bigger of bigger and better things coming out of this, so I put up with the hassle.</p>
<p>Now, I&#8217;m not going to release any bottom line numbers, (As if this time of year isn&#8217;t frought with enough identity theft problems with government requring every little bank you earn interest with and every publisher that pays you a few bucks in royalties to send out a piece of paper with everything an identity thief needs to go town with.) But there are a few interesting findings.</p>
<p>This blog and my podcasts make money, as does my wife&#8217;s kilt business. Pretty much everything else though, we&#8217;re in the, &#8220;You got to spend money to make money phase.&#8221; I hate that phase.</p>
<p>However, I will say this for the record to opponents of the <a href="http://www.fairtax.org">Fair Tax</a>. 2008 was my 4th Tax year as a Homeowner. I have yet to take a tax deduction for Home Mortgage Interest. I&#8217;ve been giving to charity longer than that and I have yet to write off a nickle of federal taxes.</p>
<p>Quite frankly, I&#8217;d rather have the Fair Tax and save all the hassle.</p>

<p><em>This video points out the inequities of our current tax code, but raises concerns about a Fair Tax for fear that without the repeal of the 16th Amendment, the Federal Government could impose both taxes. It proposes a United Effort to put the Flat Tax in place and then only ratifying a fair tax when a constitutional amendment is passed repealing the 16th Amendment. At the end of segment, the video&#8217;s creator asks viewers to answer two questions: 1) Do they prefer the Fair Tax or the Flat Tax? and 2) What do they think of the video&#8217;s proposal? I e-mailed my answer which follows below:</em></p>
<p>I favor a Sales Tax. A flat tax solves some problems, but it doesn&#8217;t solve all the problems associated with the tax including the huge compliance costs. (Although, the lack of deductions may save a little money.) As an Independent Contractor who freelances for various companies. This past tax year I have a W2 from my main job, and 8 different 1099s. Of these, the Flat Tax would get rid of 2 of these (one for a savings account that earned more than $10 in interest and another for some stock dividends.) My biggest challenge is calculating my income, not futzing with deductions or figuring out tax rates. In addition, the Fair Tax has several added benefits over a Flat Income Tax:</p>
<ul>
<li>Taxing the underground economy.</li>
<li>Increased personal privacy and less reporting requirements for individuals.</li>
<li>Control over the incidents of taxation.</li>
</ul>
<p>I could write many more arguments for the sales tax, but I&#8217;ll keep it pithy. As to your proposal of enacting a Flat Tax and refusing to enact a Fair Tax until a Constitutional Amendment passed 2/3 of Congress and is ratified by 38 states. While I think the flat tax would be an improvement on the current tax code, I believe the premise of the proposal you present is founded on a faulty premise.</p>
<p>The big fear you cite with the implementation of a Sales Tax without the repeal of the 16th Amendment is that politicians could doublecross us and we could end up with both an income tax and a sales tax and so therefore implementing the Flat Tax is a safeguard against a doublecross from shifty politicians who would implement both taxes. This to me raises a series of questions:</p>
<p>The first is, &#8220;What stops politicians from implementing both taxes right now?&#8221; There is no constitutional prohibition against a sales tax. The fact that we continue to have an income tax in no way stops Congress from imposing both taxes.</p>
<p>Secondly, if we cannot trust politicians not to try and bring upon us a twin curse of both an income and sales tax, how can we trust them to keep a Flat Tax flat? As the top income tax bracket did not begin at 91% (the point it reached prior to JFK&#8217;s tax cuts) and become a minefield of special interests loopholes overnight, it&#8217;s easy to see how the Flat Tax could be unflattened. Somebody says, &#8220;We really need a deduction for this or that very important thing (be it college tuition, health insurance, etc.) and we ought to make it so the middle class doesn&#8217;t pay so much and the wealthy pays a little more.&#8221; Within short order, you can unflatten the tax code gradually and you end up back where we are now. How can we keep the Flat Tax flat? Will special interests just give up as long as there&#8217;s money to be had, and favor to be curried. I think not. If we&#8217;re looking for a tax code that allows us to avert our gaze and trust our politicians, no such system exists. Without citizen involvement, either the Fair Tax or the Flat Tax will be corrupted.</p>
<p>Under a National Retail Sales Tax, it really becomes hard for Congress to bring back the Income Tax. H.R. 25, the Fair Tax Bill, repeals the old Internal Revenue Code and its onerous series of taxes and withholding. The most likely attempt to revive the income tax will come, not from the Congress that would enact the Fair Tax but a subsequent one, 2-4 years down the line. Unlike with the Flat Tax, with the Fair Tax, we’ve taken the system of income and payroll taxes and taken a sledgehammer to it. Unlike, gradually adding in loopholes and making the Flat Tax “more progressive,” those who’d like to bring the income tax would have to reconstitute the whole system, re-recruit tax collectors who’d moved to other jobs. Imagine being that hearty politician who steps to the floor of the House and proposes reconstituting the IRS and all that went with it. It would be political suicide, and no one in their right political mind would even go there.</p>
<p>If we’re not vigilant, however, no tax system will protect us: Fair Tax or Flat Tax.</p>

<p align="left">What do we make of John McCain&#8217;s Hispanic Outreach director <a href="http://michellemalkin.com/2008/01/25/john-mccains-open-borders-outreach-director-the-next-dhs-secretary/">having a record </a>as a proponent of open borders who served in Vicente Fox&#8217;s cabinet with the goal of insuring Mexican immigrants don&#8217;t &#8220;go native&#8221; and maintain their first loyalty to Mexico. At the very least, you know a man by the company he keeps.</p>
<p align="left">John McCain&#8217;s <a href="http://www.clubforgrowth.org/2008/01/straight_talk_express_takes_de.php">re-interpretation of his Ted Kennedyesque opposition to the Bush tax cuts</a>.</p>
<p align="left">Meanwhile, Bill Clinton <a href="http://politicalticker.blogs.cnn.com/2008/01/25/bill-clinton-john-mccain-and-hillary-are-very-close/">insists</a> a Hillary-McCain campaign would be a love-fest.  Which is probably true, which is why even John McCain&#8217;s mother <a href="http://politicalticker.blogs.cnn.com/2008/01/25/mccain%e2%80%99s-mom-takes-on-gop/">knows he&#8217;s not getting support from the GOP base</a>, because McCain&#8217;s got a record only a mother could love.</p>
<p align="left">However, at the same time, Mitt Romney&#8217;s not great either. The price of his signature accomplishment (i.e. health care reform) as Governor is <a href="http://www.cnsnews.com/ViewPolitics.asp?Page=/Politics/archive/200801/POL20080128a.html">soaring out of control </a>and will likely necessitate a tax incrase.</p>
<p align="left">Illegal immigration <a href="http://www.city-journal.org/2008/18_1_blacks_and_immigration.html">impacts the Black Community</a>, leading to anger against the Congressional Black Caucus. (Hat Tip: <a href="http://instapundit.com/archives2/014470.php">Instapundit</a>.)</p>

			<content:encoded><![CDATA[<p>Club for Growth issues <a href="http://www.clubforgrowth.org/2008/01/rudys_bold_tax_cut_plan.php">effusive praise</a> for Rudy Giuliani&#8217;s tax plan, which basically extends the 2001/2003 tax cuts, cut Capital gains and dividends rates, as well as Corporate Income taxes. Good enough, but the Club praises his 3 bracket &#8220;Flatter Tax&#8221;:</p>
<blockquote><p>The Giuliani tax cut plan also contains a particularly bold pro-growth tax simplification strategy that would give taxpayers the option of opting into a simple tax plan in which their taxes could be done on one page. Instead of the current tax behemoth, the voluntary tax plan would constitute across the board cuts in marginal tax rates by proposing three simple rates of 10%, 15%, and 30%&#8230;</p>
<p>“The current U.S. tax code is a monstrosity of inefficiency and deterrence, with some of the highest corporate tax rates in the developed world and a tax code that totals more than 66,000 pages. Mayor Giuliani’s tax cut proposal today would dramatically move the American tax code and economy in the right direction. This is exactly the kind of plan economic conservatives should embrace.”</p></blockquote>
<p>Yes, and the Giuliani wouldn&#8217;t eliminate a single page. It would take us from five brackets to three for those who chose to go with it. While I&#8217;ve generally thought, Fred Thompson&#8217;s weakest plan was his <a href="http://www.fred08.com/virtual/taxrelief.aspx">tax reform proposal</a> but in all measures (other than Thompson wanting the Corporate Tax reduced to 27% rather than the 25% Rudy requests), he kicks the Giuliani plan&#8217;s posterior with 2 rates rather than 3 (which is what we had from 1988-1990 anyway.)</p>
<p>There are inherent problems with optional flat taxes, or optional &#8220;flatter taxes&#8221; as both plans embrace. The complexity of the tax code is not solved. Instead, we just create another tax form that taxpayers may or may not use. Corporations and individuals that spend billions lobbying so they can get tax breaks will continues to use the old form and we really haven&#8217;t solved a whole lot of anything when it comes to the major problems other than making it less apparent to those who fill out the &#8220;shorter, flatter form.&#8221; In addition, I don&#8217;t know about you, but most of my tax filing time is spent figuring out income (you know with 1099s for Savings Interest, Internet odd jobs, etc.) not calculating tax deductions.</p>
<p>While Giuliani&#8217;s tax plan would be nice if implemented, it&#8217;s the least bold in this race at this point, except for whatever McCain&#8217;s proposing.  </p>

			<content:encoded><![CDATA[<p>To say the reaction to my last piece on the Fair Tax has stirred conversation would be an understatement. I’ve been called every name in the book except for the worst possible insult. No one has yet to accuse me of being a Yankees fan.</p>
<p>In all seriousness, much of this has come from my fellow conservatives, and has been directed at myself and other supporters of the Fair Tax. It’s amazing the amount of bile and vitriol in conservative circles. There’s a reasonable disagreement over whether we should have a Fair Tax, a Flat Tax, or tinker around with the current code. I don’t think anyone advocating these positions, least of all, grassroots pundits, are intentionally misrepresenting anything. If, within our own ideological camps, we can’t even reasonably disagree, then we are in for serious trouble as a nation. </p>
<p>There are a few areas of confusion that do need to be cleared up. The first is in regards to the rate of a National Retail Sales Tax. It’s a 23% tax inclusive rate. That means 23% of the shelf price of a product goes to the tax. However, this is not the way states calculate tax. State sales taxes are a tax exclusive rate that is added up at the register on top of the shelf price of the product. </p>
<p>The fair tax takes a pre-tax cost of a coat at $77, adds in a $23 tax that brings the shelf price to $100, and says that the coat has a 23% tax inclusive rate because the tax makes up 23% of the shelf price of the coat. </p>
<p>Under the state sales tax/exclusive tax rate model, using the same numbers, the shelf price of the coat is $77 and the additional $23 in tax added at the register is 29.87% of that. Your total bill is still $100, only you may find yourself over budget if you forgot about the tax or miscalculated it.</p>
<p>Fair Tax opponents insist the tax inclusive rate is used to make the Fair Tax seem smaller, thus jumping to motives and mind-reading in a political debate. There’s actually a far less sinister motive. </p>
<p>The tax exclusive rate doesn’t actually tell us a whole lot when it comes to the cost of the tax. Try asking this question of someone, “If you’ve spent $10,000 including tax and the tax is 30%, how much tax have you paid?” I’ll wager that in most cases, the person will either shrug their shoulders or incorrectly identify the amount as $3,000 (the correct answer is $2300.) Figuring out 23% gives people a far better idea of the overall cost. I suppose we could universally agree to state the Fair Tax as “29.87% which equates to 23% of what you spend”, but barring that, the 29.87% is as likely, if not more so, to confuse the issue than the 23% rate.</p>
<p>Second is the issue of embedded taxes. In my previous column, I reported that embedded taxes were 22% of the price of goods and services. While this was accurate, there was an issue with the computation of those taxes. The professor who calculated the rate included taxes employees had to pay on their own income. </p>
<p>What this meant is to achieve a 22% cut in prices as a result of a Fair Tax, employers would have to cut Employee wages to their current after-tax amount. In many cases, this isn’t possible due to minimum wage laws and written labor contracts, nor is it feasible that most companies will be able to pull this off. Those who try would find a rush of employees heading for the door. The only exception here would be the self-employed (Contractors, Lawyers, Doctors, etc.) who have to pay their own employer portion of the payroll taxes and whose income taxes are directly paid by their clients. </p>
<p>Therefore, without employee taxes, the best estimate I can find is an embedded rate of 10-12%. I’d lean towards the 12% figure due to self-employed people reducing some pre-tax prices further to remain competitive.</p>
<p>Under this scenario, most people will still come out ahead. Not only will everyone have 100% of their earnings without income or payroll taxes taken out, but every American household will be issued a prebate at the start of the month that will cover the cost of paying the tax up to the poverty level. In addition, savings, retirement, tuition, the purchase of used goods, loan payments, and charitable contributions will not be subject to tax. As it is now, only the 30% of Americans who itemize can claim the mortgage and charitable deductions. </p>
<p>Still, its undeniable that there will be some losers under the Fair Tax. If we&#8217;re looking for a plan without losers, then we might as well lay aside the issue of tax reform. Trying to say, &#8220;Everybody&#8217;s a winner,&#8221; particularly in the short term, is great politics, but it&#8217;s unrealistic policy. Every plan will have winners and losers. For example, under the Flat Tax, my wife would lose her student loan interest deduction. Itemizing Americans lose tons of deductions under the Flat Tax as well. Under the Fair Tax, I lose the savers tax credit, which in addition to my tax deduction for retirement savings, gives me a partial tax credit for each dollar I save for retirement. </p>
<p>That said, ultimately, we&#8217;re all losing under the current tax system. Our complex income tax code is helping to drive jobs and investment offshore. The tax code is a $400 billion drag on our economy in compliance costs alone, drives our trade deficit, punishes investment and achievement, and helps foster a culture of corruption in Washington. </p>
<p>A reasoned debate needs to be had over how we fix these problems, not just a selfish argument over who benefits and who doesn&#8217;t.  </p>

			<content:encoded><![CDATA[<p>Does the Fair Tax cause undo harm to the elderly? This was recently a topic on a popular conservative Internet discussion board.</p>
<p>The theory is laid out by the first commenter: “Who are the people who get screwed by the National Sales Tax? Older people, who already paid taxes over the years on what they made, and under the National Sales Tax get to be taxed again on the same money they already made.”</p>
<p>So is this the case or is there more than meets the eye? Let’s take a look.</p>
<p>First of all,so we know what we&#8217;re talking about, the Fair Tax eliminates the payroll tax, personal and corporate income taxes, gift taxes, estate taxes, and capital gains taxes and places a tax-inclusive rate of 23% on all new goods and services purchased in the United States in their place.</p>
<p>So what about the elderly who have paid taxes all their lives and are going to taxed again?</p>
<p>First, we must remember a key concept called embedded taxes. Taxes on Corporate Income, the employer portion of Payroll Taxes, costs of complying with the tax code, etc. are business expenses. These expenses are passed on to the consumer. Many modern products go through multiple corporations and each corporation passes on some of their tax burden to consumers. It’s estimated that on average, 22% of the price of goods and services in the United States are made up of embedded taxes and senior citizens pay for that. So, if the Fair Tax gets rid of the 22% embedded tax, the 23% Fair Tax will not greatly increase the costs of goods and services.</p>
<p>Second, at the start of each month, every American household will receive a prebate equal to the amount of money needed to pay for spending up to the poverty level in order to insure that the tax does not stop people from being able to purchase the basic necessities of life. So, thus a senior citizen will see prices rise moderately, but they’ll also have prebate that will, in most cases, more than make up for the higher prices. Now, many people have issues with the prebate, but let’s save that for a separate column.</p>
<p>The third issue here is the assumption that the elderly are done paying taxes. If your income comes entirely from sources such as Social Security or some other tax-free arrangement, then that&#8217;s correct, but if that’s the case, your monthly prebate will most likely take care of your taxes.</p>
<p>However for those who have saved for retirement or have a pension, this is almost certainly not true. Unless they saved with post-tax dollars, retirees will pay taxes on their benefits. Most pensions are taxed. IRAs and 401(k)s are not tax-free ways to save for retirement, they are tax deferred, which means that when you take the money out, you pay taxes. If you saved outside of a retirement account in a normal savings account or brokerage account, you still have to pay Capital Gains tax when stocks are sold, a tax on dividends from corporations in which you own stock, and a tax on the interest you earn on savings.</p>
<p>Under the Fair Tax, there’d be no taxes on distributions, no taxes on interest, dividends, or capital gains. Thus, people would not pay taxes on their retirement accounts until they actually choose to spend the money on taxable goods.</p>
<p>Finally, remember that under the Fair Tax, you and I get a choice as to when we get taxed. If we choose to save our money or buy a used item instead of a new one, there is no tax. If you buy a less expensive item, it has a lower amount of tax. Buying used clothing, used cars, used furniture, etc. can help the elderly avoid taxes in many instances as well. Many already make such frugal choices as it is and the fair tax would reward that.</p>
<p>Ultimately, due to embedded taxes and the prebate, you&#8217;ll have to strain to find seniors who will be hit hard by a Fair Tax. While the Fair Tax will not benefit them as much as younger workers, that is no reason to continue with a system that harms our economy, robs us of time with our families, and invades our privacy.</p>

			<content:encoded><![CDATA[<p><a href="http://mountaingoatreport.typepad.com/the_mountaingoat_report/2007/12/warped-prioriti.html">The Mountain Goat Report was quite outraged</a>with my response to Idablue <a href="http://www.adamsweb.us/blog/the-secret-of-taxes-and-empty-good-intentions/">regarding increasing taxes on Oil Companies</a>. I wrote:</p>

<p>MGR writes:</p>
<blockquote><p>See, here&#8217;s where these ultra-conservative priorities have gone horribly wrong.  This guy&#8217;s actually arguing <em>for</em>corporate welfare.  Pay off corporations earning billion-dollar profits with tax subsidies and hope in return for lower consumer prices; take away that government teat and well. . . .  Somehow visions of wedgies and swirlies are dancing in my head.</p></blockquote>
<p>Notice the change in language. A tax deduction for oil companies is a &#8220;tax subsidy.&#8221; I guess a lot of folks out there are getting tax subsidies for their Home Mortgage or their Student loan, though no one refers to them that way. Actual subsidies (say like what we give to farmers), I wouldn&#8217;t have a problem getting rid of. Nor would I have a problem eliminating the tax credits were it to go somewhere that would benefit the American taxpayer such as cutting the gas tax by a penny or two.  Ultimately, raising federal taxes to increase the size of government (because government refuses to reduce its spending and Democrats want it to have a greater role in our lives) is not something I would ever countenance.</p>
<blockquote><p>Gee, worship at the altar of corporate greed, much?  With <a href="http://www.adamsweb.us/blog/the-secret-of-taxes-and-empty-good-intentions/">this logic</a> (and I use the term loosely), why not just repeal all corporate taxes?</p></blockquote>
<p>My thoughts exactly and yes, that&#8217;s a good idea. For those who pay only occasional attention to this blog, I <a href="http://www.fairtax.org">strongly endorse the Fair Tax</a>. How does the Fair Tax work?:</p>
<ul>
<li>It&#8217;s a National Retail Sales Tax where all goods and services are taxed once and only once (at the point of purchase.)</li>
<li>All income, payroll, corporate taxes, and estate taxes are abolished.  </li>
<li>To insure that the poor are not hit, every American is given a prebate at the start of the month for what amounts to the poverty level of spending based on their family size.</li>
</ul>
<p>There are three principal reasons I support the Fair Tax.</p>
<p>First, it will create a more transparent system.  When you buy any good or service, be it a box of cereal or card, you&#8217;re not just buying that good or service. You&#8217;re paying for the compliance costs of the Corporation to pay its taxes, you&#8217;re paying the payroll taxes for all the employees of the company, and you&#8217;re paying the Corporate Income tax. This is called the <a href="http://boortz.com/nuze/200509/09152005.html">Embedded tax</a> and it accounts for on average to about 22% of the cost of everything you buy that&#8217;s made in the United States (depending on what you&#8217;re buying, your milelage may vary a few percentage points.)</p>
<p>So, thus $2.00 for a box of cereal could include 44 cents in embedded taxes. If you buy a $20,000 car on average $4,400 of it is embedded taxes. Embedded taxes are nice for tax and spend politicians. Because the government can raise taxes on a hated group: &#8220;Corporations&#8221; or &#8220;Rich People&#8221; anyone that we like to envy and soak and the American people think &#8220;they&#8221; (those evil other people) will actually pay the taxes, never understanding that Corporations and Rich people will get their money, by passing on their tax increase to consumers.</p>
<p>The second reason I support the Fair Tax and it goes back to embedded taxes as well is that our current system has created a huge trade deficit. Europeans in general have little interest in paying for our Corporate Income Taxes or the Employer Portion of our payroll taxes. Buying from China or from within Europe makes a whole lot of sense for your average European.</p>
<p>Mitt Romney (a non-fair tax support) <a href="http://www.mittromney.com/News/Press-Releases/Romney_Agenda_10.9.07">explained the problem</a> with our indirect taxation quite bluntly:</p>
<blockquote><p>In the global economy, American products carry a very heavy load known as embedded taxes. It&#8217;s estimated that our products face about a $100 billion disadvantage around the world. Because of a WTO ruling, taxes that are embedded in Americans products cannot be refunded to exporters.</p></blockquote>
<p>Romney says he&#8217;d fight to level the playing field for American goods and services overseas. If he intends to get that through the WTO, I have to say, &#8220;Good luck.&#8221; The WTO, a body in which America has no vote or veto power is not going to help us out or level the field. They have no incentive whatsoever to do so. (Thus why turning control over control of our trade to our competitors was a stupid idea.)</p>
<p>The only realistic solution is to get rid of embedded taxes ourselves and we can do that through the Fair Tax. Without our high taxes on Corporate profit, we&#8217;ll also be able to see jobs return to America. To vilify Corporations for sending jobs out of the country, while our government gives them every reason to go through their absurd tax policy is short-sighted at best.</p>
<p>I believe that we can either have a healthy export market that will attract jobs and investment or we can continue to embed the cost of government into goods and services to play shell games with the American people. We cannot do both.</p>
<p>Third point is privacy. And I&#8217;ll say briefly that often wonder about liberals who get upset because the government can find out if they placed a call to Osama bin-Laden, but have no problem handing over every aspect of their personal financial lives. Quite frankly, I would look forward to the day when it&#8217;s once again none of the government&#8217;s business where I worked, how much I earned, or what interest I paid or earned on anything.</p>
<p>That&#8217;s my ideal situation. No tax breaks for oil companies, no tax breaks for anyone, no games, no lies, just a pure and simple tax that shows us all the price of government.</p>
<p>One final matter. At the end of her piece, MGR writes:</p>
<blockquote><p>But when Democrats talk about providing preventative health care for kids (or anyone for that matter) who may then grow up to be healthy, productive members of society . . . why, that would be out-<em>ra</em>-ge-ous.</p>
<p>Talk about family values.</p></blockquote>
<p>I&#8217;m not against providing preventive health care to anyone. I&#8217;m all for people getting preventive health care. However, when Democrats talk about it, they never put their own money where their mouth is to as an act of charity support a community health center. What is proposed is that the government do it and the government take charge of it. That&#8217;s not the role of government, that&#8217;s the role of local communities where people care about one another. The liberal solution always end up providing the same benefit that could have provided at the community level, while adding on thick layers of government cost and bureaucracy.</p>
<p>So, I don&#8217;t disagree with the ends, only the wasteful, inefficient and anti-freedom means.</p>

I watched his <a href="http://fredfile.fred08.com/2007/ask-fred-fixing-the-tax-code/">episode on tax reform</a>. Thompson correctly identified all the problems with the tax code, but if you&#8217;re looking for a plan, you&#8217;ll have to look elsewhere.</p>
<p>Identifying the problems with the tax code is easy. Every candidate, Republican and Democrat knows the tax codes needs to be &#8220;simpler, fairer.&#8221; Yeah, yeah, every Presidential Candidate I&#8217;ve ever seen has said the same thing.</p>
<p>However, when a candidates doesn&#8217;t have a plan, not a whole lot happens. That he&#8217;ll &#8220;consider&#8221; the fair tax or flat tax is not a plan. That options will be on the table is not a plan. And as the old saying goes when you fail to plan, you plan to fail. I want to take you back to the 2004 Republican National Convention when <a href="http://www.whitehouse.gov/news/releases/2004/09/20040902-2.html">President Bush said</a>:</p>
<blockquote><p>Another drag on our economy is the current tax code, which is a complicated mess &#8212; filled with special interest loopholes, saddling our people with more than six billion hours of paperwork and headache every year. The American people deserve &#8212; and our economic future demands &#8212; a simpler, fairer, pro-growth system. (Applause.) In a new term, I will lead a bipartisan effort to reform and simplify the federal tax code.</p></blockquote>
<p>Whatever happened to that? Fail to plan, plan to fail. Tax Reform seems to be like losing weight. At the start of the year, losing weight is on the top of many people&#8217;s priorities, but who actually loses? Those who plan a new course of action and follow through.</p>
<p>If you&#8217;ve got a general idea we need tax reform, what&#8217;s going to happen in Washington? Nuthin&#8217;, nada, and zilch. You&#8217;ll get to Washington and be focused on other things, Congress won&#8217;t move in  your direction and if you think a bi-partisan commission will make major reforms, take a look at what President Bush&#8217;s <a href="http://www.taxreformpanel.gov/final-report/">commission produced</a>. The best we get is some tax cuts, which while helping grow the economy don&#8217;t address the major issues only working around the edges.</p>
<p>As I count it, there are six candidates (Cox, Huckabee, Hunter, Keyes Paul, and Tancredo ) that support the fair tax and two that support the Flat Tax (Brownback and Giuliani). Now I wouldn&#8217;t support many of these candidates for other reasons (especially Rudy Giuliani), they will be more likely to get tax reform done than those who back think the code is too complex but can&#8217;t seem to find anything they specifically want to do (McCain, Romney, and Thompson).  Just like the guy who buys a Bow Flex and a South Beach book will probably lose more weight than the guy who will consider buying one.</p>

			<content:encoded><![CDATA[<p>I have to feel for the folks who are getting sticker shock with this year&#8217;s tax <a href="http://www.idahostatesman.com/opinion/story/87844.html">bill</a> including Boise&#8217;s George Minow:</p>
<blockquote><p>Although I will be calling the Ada assessor&#8217;s office, I wanted to let the Ada County commissioners know that my property taxes went from $6,233.10 to $8,084.66, or up about $1,850. That means that I will need to get a raise of approximately $2,500 this year just to pay my taxes. My house value went up 14 percent; however, my land went from $160,000 to $256,000 or 60 percent in one year. Remind you, that last year when I spoke with the assessor, the $160,000 was fair value.</p>
<p>I expect to meet all the commissioners at the board of equalization hearing and I hope they are prepared to answer why they think my land increased in value $94,000 or 60 percent in one year. By the way, any idea how to get a $2,500 raise from my boss?</p></blockquote>
<p>Good question. I had something odd happen where they dropped the value of my house down to $30,000 and raised the value of my land by about $40,000. Mind you, I live on a small plot in a townhouse complex that may be 450 square feet when the patio&#8217;s taken into consideration. There are odd things going on. Even so, Dennis McDowell of Bigfork gives some good advice in his letter:</p>
<blockquote><p>The increase in property valuations in Boise is cause for concern to many of us as it leads to higher property taxes. Higher taxes are not the fault of the assessor&#8217;s office, but the spending habits of the elected officials that approve the budgets for Boise and the surrounding communities.</p>
<p>I was born and raised in Boise but now live in Montana. Our property taxes are at least 50 percent less than in Idaho, and we do not have sales tax. Just because the values increase does not mean that taxes must. Just lower the mill levy and be more frugal with our money.</p></blockquote>
<p>Good wisdom, Mr. McDowell, I&#8217;d still like to know what happened to my property value. It&#8217;s no big deal as the net effect was only a $10,000 increase in valuation (and as my house is still within the Home Owner&#8217;s exemption of $5,000, it&#8217;s not a heck of a lot.)</p>
